DECISION OF THE MINISTER OF SCIENCE AND TECHNOLOGY
Promulgating statutes on the organization and activities of the review “Science Activities”

THE MINISTER OF
SCIENCE AND TECHNOLOGY

Based on decree no. 54/2003/NQ-CP date 05/19/2003 of the government prescribing functions, tasks, powers and organizational structure of the Ministry of Science and Technoly, and decree no. 28/2004/NĐ-CP date 01/16/2004 of the government amending decree No. 54/2003/NĐ-CP;

Upon examination of the proposal of the editor in chief of the Science Activities Review and the head of the organization and staff department;

DECIDES

Article 1: To promulgate attached to this decision the statutes on the organization and activities of the Science Activities Review.

Article 2: This decision will be effective 15 days after its publication in the official journal and supersede decision No. 457/QĐ dated 12/21/1972 of the State Scientific and Technical Committee (presently Ministry of Science and Technology) promulgating statutes on the organization and activities of the review “science activities”.

Article 3: The chief of office, the head of the organization and staff department, the editior in chief of the review “Science Activities” and heads of relevant units are responsible for the implementation of this decision./.

STATUTES
ON THE ORGANIZATION AND ACTIVIVITIES OF THE REVIEW “SCIENCE ACTIVITIES”
(Promulgated attached to decision N. 04/2004/QĐ-BKHCN date 04/29/2004 of the Minister of Science and Technology)

 

Chapter I
FUNCTIONS, TASKS AND POWERS

Article 1. The review “science activites” (hereunder referred as the Review) is a non-productive unit carrying out opinion expressing and the theoretical functions of the Ministry of Science and Technology.

The English transaction name of the review is “Science Activitives Review”.

The Review is a legal person having its own seal and accounts opened at the State Treasury and banks for its activities and transactions as prescribed by the law.

The Review has its head office in Hanoi and a representative office in Ho Chi Minh city.

Article 2. The review is responsible for assisting the Minister of Science and Technology in editing and publishing the review with contents dealing with matters, lines and policies for scientific and technological development for the Party and the State, with regulations, policies and mechanics for managing scientific and technological activities, with scientific and technological activities at home and abroad for the purpose of building an advanced scientific and technological foundation to serve industrialization and modernization efficaciously, contributing fruitfully to National economic and Social development.

Article 3. Main intended readers of the review:

Leaders of branches at all levels of the Party and the State;

Economic managers, education and training managers, managers, researchers and implementors in the scientific and technological field;

Scientific and technological managers and specialists in the production and bussiness field belonging to all ecnomic sectors.

Article 4. The review has the following taks and powers:

1. To study and submit to the Minister of Science and Technology projects on the orientation, policies and development for the review at each period in conformity with economic, social, scientific and technological development state of the Nation.

2. To implement aims and purpose determined in the Press Activity Licence, specifically:

a.

To make propaganda and disseminate the lines and polices of the Party and laws of the State on scientific and technological building and development for national building and development;

b.

To exchange and disseminate experience in scientific and technological management and activities from ministries, branches, localities, research and implementation agencies, production and bussiness enterprises belonging to all economic sectors in the Nation;

c.

To reflect outstanding scientific and technological activities achieved by ministries, branches, localities, research and implementation agencies, production and business enterprises belonging to all economic sectors in the Nation;

d.

To introduce outstanding scientific and technological achievements worldwide;

e.

To be a forum for managers, scientists and technologists about matters relating to national scientific and technological development.

3. To ensure that the review complies with the lines and policies of the Party and State and achieve high scientific and technological quality.

4. To organize a good network of collaborators.

5. To cooperate with the Press, publishing firms, scientific organizations at home and abroad to develop the review in conformity with its aims and purposes and law prescriptions.

6. To have the authorization to issue extra publications (supplements, supplemetary pages, special issues) to carry out services in relating fields according to the Press law; to carry out other tasks assigned by the Ministry.

7. To manage the organization, staff, property and archieves of the review according to powers delegated and prescribed by the Ministry.

 

Chapter II
Organizational structure

Article 5. The organizational structure of the review comprises:

1. The editorial staff.

2. The secretariate and reader section.

3. The administration and material section.

4. The representative office in the South.

The review is organized and operates according to the one-chief system, having an editor in chief at its head assisted by several deputy editors in chief..

The editor in chief is responsible to the Minister for the whole organization and activities of the review, responsible to the Party and the State for the review contents.

The editor in chief is responsible for prescribing tasks, organization and activities for the review specialized sections.

The deputy editors in chief are responsible for assisting the editor in chief in the general direction of the review, are responsible to the editor in chief for their assigned tasks and have the right to make decision on the matters empowered by the editor in chief. When the editor in chief is absent, a Deputy editor in chief replaces him to manage and settle the review affairs.

Article 6. The review has an editorial commission, the organization, activities and members of which are decided by the editor in chief.

Article 7. The review human resources comprise:

1. Official staff fixed every year by the Ministry.

2. Contractual staff: Based on activity needs and the financial resources of the review, the editor in chief signs contracts with workers according to the Labour Code (without approval by the organization and staff department). In particular with contracts without terms, they must be reported to this Department for monitoring.

3. Staff working as collaborators.

Article 8. The review carries out regulatious on labour management, the payment of salaries, wages and other. incomes, carries out regulations on social security for its official staff and contractual regulations of the state and the ministry of science and technology.

 

CHAPTER III
RELATIONS WITH OTHER AGENCIENS

Article 9. The editior in chief manages all the review activities based on the statutes on the organization and activities of the review and working regulations of the Ministry.

Article 10. The review is responsible for working in close coordination with other units of the Ministry to implement with efficacy its assigned opinion-expressing and theoretical tasks, specifically.

The review is provided with favourable conditions by the Ministry and its units to exploit and use relevant documents necessary to the review political tasks.

In the process of building the orientation and contents to publish every year, the Review is provided by the Ministry units with timely announcements concerning policies on scientific and technological development for the State and each branch, concerning outstanding results of scientific and technological activities in each responsible field.

The Review editorial staff is invited to conferences dealing with scientific and technological activities of the Ministry and its units to prepare contents to publish timely and in accordance with actual needs.

 

Chapter IV
Financial management

Article 11. Financial management

1. Receipts:

a) From the State budget;

b) From relevant publications of the Review and other activities in conforming with the Review aims and purposes;

c) Other receipts as prescribed (if any): assistance projects, donations, credit loans…

2. Expenses:

a) Expenses for assigned permanent tasks and others;

b) Expenses for privating and issuing publications; other activities and services as prescribed by the law;

c) Wages for working;

d) Other expenses as prescribed by the law.

Article 12. The Editor in Chief is responsible for managing and using the Review financial resources with efficacy, carries out its obligation to pay taxes to the Government, establishes funds for development and welfare with money deducted from profits and keeps accounting books in conformity with current State regulations.

 

CHAPTER V
Implementation clause

Article 13. The editor in chief, in coordination with the organization and Staff Department, implement these statutes.

Article 14. Any amendment to these statutes is proposed by the editor in chief in coordination with the organization and Staff Department to the Minister of Science and Technology for consideration and decision.
